On November 7th, the New Hampshire Supreme Court ruled that homosexual sex isn't sex.
Everyone say, huh?
A man was seeking a divorce from his wife for her adultery, with another woman, and the wife contended that becauce her relationship was with another woman, that it didn't count as adultery. At trial, the jury didn't buy this for a second and ruled in favor of the husband, for the divorce to go through. However, the woman appealed to the state supreme court, and won. Some of the details I took from the court's official ruling are here below:
"The plain and ordinary meaning of adultery is "voluntary sexual intercourse between a married man and someone other than his wife or between a married woman and someone other than her husband." Webster’s Third New International Dictionary 30 (unabridged ed. 1961). Although the definition does not specifically state that the "someone" with whom one commits adultery must be of the opposite gender, it does require sexual intercourse.
The plain and ordinary meaning of sexual intercourse is "sexual connection esp. between humans: COITUS, COPULATION." Webster’s Third New International Dictionary 2082. Coitus is defined to require "insertion of the penis in the vagina[]," Webster’s Third New International Dictionary 441, which clearly can only take place between persons of the opposite gender.
As noted above, the concept of adultery was premised upon a specific act. To include in that concept other acts of a sexual nature, whether between heterosexuals or homosexuals, would change beyond recognition this well-established ground for divorce and likely lead to countless new marital cases alleging adultery, for strategic purposes."
To summarize, the court ruled that becuase their state law doesn't include sex with a person of the same gender adultery, and because the dictionary defines sex as the penis entering the vagina, that the grounds for adultery do not exist for the husband. So, homosexual sex isn't sex after all. I wonder if the news agencies and the rest of the country will pick up on this... Pass this story along... I think it's important for both sides of the debate over homsexuality...

Anyways, I don't think you should rule out one form or another of sex. It's all in the eye of the beholder. The goddamn Webster's dictionary shouldn't rule over the Supreme court.

Well if you think about it... two guys messing around isnt really sex... i wouldnt call two men doing that sex.

I consider sex between two of the same gender sex. I guess that supreme court hasn't seen Chasing Amy. ;)
However, this does bring to mind the old proverb: "If it's eatin' it's not cheatin'." :D

Okay that does it....first I read about a jury awarding a man millions of dollars from an RV manufactuer because he dosen't know the difference between "CRUISE CONTROL" and "AUTOPILOT" (dip-shyte set the Cruise on 70 and went to the back to make some coffee and crashed, sued the makers of the RV and won)...
Then I read of a woman suing the owners of a store because she fell over an unruly kid that was running amok in there...HER OWN...and winning...
Now this...."sorry chum, only counts as CHEATING if it;s with the opposite sex!"

sex is sex apart from the laws of gay sex being held untill the age of 18. but my question is that why doesnt this law apply to lesbians?? the government seem to deny they know about them not that i have a problem with it coz i have loads of gey friends who are so great and we all have a laugh

This did apply to lesbians. This ruling was based on two woman engaging in sexual activity, and the ruling was that it wasn't true sex, under NH state law and the definition in the dictionary.
I think the ruling is very interesting. I hadn't looked at the debate over homosexuality this way before. This reminds me of the debate over whether oral sex truly is a form of sexual intercorse....
Being a Christian, I am against homosexuality, and this includes all sexual acts between those of the same gender, whether you call it sex or not. I'm not intollerant, as I try and love everyone as my neighbor (I'll be the first to admit I don't always do) but while I can accept someone's lifestyle choice, I just don't agree with it.
I for one don't see anything significant coming out of this ruling. The questions of same-sex marriages won't be affected by this ruling, in my opinion, and neither will other issues. However, I'm not a lawyer, and perhaps this can be used as a precedent in the future in some way... I ask everyone to remember this is only in NH currently, and I have yet to hear much about this on any serious news outlets. But like I said in my first post, let's wait and see...

I agree with LadyFireFly. Sex is sex. Someone was getting their jollies and in my book that is sex. The other point, the wife flat out, no mincing of words, she cheated. She recited certain vows at a marriage ceremony and went back on those words. Cheating is cheating, whether it is with someone of the same sex, different sex, on-line or on the phone. When you and your significant other stand at that altar or in front of the judge, you are making a promise and vow to love, honor and cherish that person till death do you part. If you don't mean it, don't say it. The courts need to wake up and smell the coffee.

Ok I have a question, if his wife had approached an undercover female police officer that was posing as a prostitute and tried to solicit these acts from her for money would she have been arrested in NH? Or is the judge who ruled in her favor was forcibly sodomized would that then be considered assault of sexual assault in NH?
Do you see what I'm getting at.

no thats not sex either - same sex partners cant have sex with each other - its just a physical impossibility. Of course these gay types say they are having sex but there not. They can have a sexual relationship but its still not sex.
If i go off with a girl and do all the things that lesbians do I still cant say ive had sex with her.
Its still cheating though - which is a completely different question.
